Sworn testimony constitutes evidence, but it is up to a court to decide if it is compelling-evidence such as to decide the matter. Therefore the accuracy and sincerely of anyone's evidence is up to the court to decide having regard to all the evidence given in the case.
Because of that, it would to be inappropriate for me, not having heard the evidence and not being part of any court deciding the matter, to give any opinion; in summary therefore, I consider it to be up to the court to decide.

You insist that war crimes cannot be happening in Gaza because the evidence given be it video or testimonial cannot be verified until a court has seen the evidence and ruled on it.
But you accept, given the video and testimonial evidence, that Hamas committed war crimes on Israel on Oct 7th without the need for a court to verify and rule on the evidence.
Do you not see the contradiction?

The meaning of the contributor's sentence is unclear, because crime is decided by a court.
Since the contributor's sentence above is unclear, their assertion there is a contradiction in what I have posted is not made out.
Certainly I do consider the allegations of war crimes against Israel ineffectual, for example the allegation of genocide requires intention, and is therefore rebutted by warnings to vacate immediate combat areas.
Regarding the sworn statement previously referred to by the contributor, the allegations made in it are very serious and merit investigation.
If the alleged incidents in the statement are found to be factual, they could indicate a rogue soldier not operating on IDF principles. It would not amount to proof of policy by the Israeli military, since such actions go directly against IDF ethos, policy and rules.

Yes, I do consider that although a court has not yet ruled on this, that here the evidence against the Palestinian Arabs / Hamas, is compelling.
I do not see that as a contradiction.
